Would you recommend getting this kind of insurance when selling files on here or not? Im a bit unsure on this… 
Or does Envato cover you on this (probably not).
Any thoughts?
To be able to indemnify yourself, you would need I think to be able to prove negligence, and/or theft and take action against the person/corporation violating your terms.
That is very hard to do, I wouldnt bother. But then this is an area I would like to know more about, so will reserve judgement as to others replies.

Im confused what would someone sue you for exactly. And Im not sure why there hasn’t been a thread discussing this kind of issue before.

Well yeah I agree, but law is split into varying components lol.
However, commercially, you would want to insure liability , and indemnification … so you are protected from both directions.
