I would like to see also Balistique here, maybe it would be better to expose his opinion. I remember some time ago also him was accused that he stole the idea for one of his projects… So I a am sure that he knows well how is the feeling to be accused.

The “problem” with DMCA is that it takes Videohive and it’s reviewing staff out of the equation.Once they receive a takedown notice they are forced to take the file down,no matter what their opinion is. You can file a counter-notice and have the file restored.

Then this is going to be misused by people.

What is the use of sending a counter notice and get the item restored to some two three pages back and losing all the exposure and benefits for the file?

Does the guy sent DMCA will pay for the loses? Or else envato?

How you validate the DMCA ? How you protect the rights of author?

What if somebody send fake or invalid DMCA for files? Who is going to fix the loses? Still nobody want to verify things?

As per envato rules the processing of the counter-notice will take 10 days. And in that time the file will be gone to void.

No, you definitely will come up with something unique if you do it yourself, without having a look on what others do, or what’s there already. That simple.

How can it be a copy? If the works is similar in style, it does not mean that it is a copy. All 3D objects have been made by the author. These are two different works. Similar. But different animations and 3d objects. I think the author spent much time and effort to make this project, so he deserves the right to sell. And buyers deserve the opportunity to buy this project! I hope Envato will correct this mistake. Otherwise it would be a bad precedent! Good luck to the author!
