(Locked) Got DMCA message

Hello. I got the DMCA message [name removed] This video which is created by myself uses only the idea from this one: http://videohive.net/item/blacknight-ii/492678

If somebody like me think that vidohive is totally wrong as well [name removed] then maybe we can change together things in this world and return my AE template back to videohive marketplace for sale.

Please, don’t write here anything those who disagree with me and agree with [name removed]. Thanx for your time.

That is totally weird.

I don’t think videohive is verifying the files before they disable the items. As soon as they receive a DMCA notice of any item they simply disable the item without any verification. And its totally wrong. Videohive should verify the files before taking further action.

And there is a possibility that some people may use it for their personal benefits.

When I first time saw your file “SciFi Party”, I remembered about Blacknight I and II. Yes, it’s similar, but nothing is wrong here. If you created and animated all 3d stuff by yourself, also exported it into AE and composited by yourself too, then I don’t see any reasons to delete your item. It’s just similar to Blacknight, like almost all 3d extrude templates looks same

But if you have stolen a source files and used them in your template, then you should be banned. But I’m sure you didn’t

How it only can be? What can I do? To upload it to Revostock? I will do it if they continue to be silent. But this is not professional. Now people I want somebody to write messages to them on this event and wake them up. Thanx!

I’m on your side with this one, especially after seeing so many of elements’s projects copied and nothing being done about it. This on the other hand is NOT copying; yes the look of projects is slightly similar but in a whole these two projects are completely different. It’s sad that this happened to such a good author. I hope you figure it out…

Buddha, I agree with you! I didn’t see any reason for delete your item. VH and balistique not right! Recently one of the authors raised the question of the similarity of the projects. He got answered. Projects similar in idea but implemented differently. In your case, you can say the same thing.

Your item is more versatile and more universal than balistiques. I would buy your instead of his, I think thats why balistique was affraid of leaving this item unreported.

It reminds item of his very very little bit. But then I would suggest to delete third of all VH items which reminds transformers, batman, lincoln lawyer, american style openers, and so on ….

Using same technique doesn’t mean you are using same idea.

Envato should change their process for DMCA complaints. They should be reviewing the files before they take any action. Atleast they have to follow this for Videohive.

As soon as they get a DMCA Complaint they should forward the complaint to the videohive reviewer to verify the claim.

Now some authors may want to use this DMCA as a weapon to use it against another authors file considering it may become a hit and affect his earlier files.

Now its becoming like people may send DMCA notice just because he created a circle animation and somebody else also created circle animation. As if they own the copyright for circle.

Envato should protect every single author’s basic rights.In this case i don’t think envato is doing that.

The “problem” with DMCA is that it takes Videohive and it’s reviewing staff out of the equation.Once they receive a takedown notice they are forced to take the file down,no matter what their opinion is.

You can file a counter-notice and have the file restored.
