The point of stock is to make it so that you never have to stay up until 3am on a project. It’s not to take the place of custom work, but to enhance it. Almost all of my freelance projects use stock in some way. I’ve used stock in major projects including rightguard.com. I wouldn’t be embarrassed in any way if they knew that I used stock. I’m not a 3d guy or a photographer so if I don’t need to pay lots of money for a freelancer, I won’t. Why would I pay for a photo shoot when I could get the exact same thing for a dollar? There’s nothing illegal or unethical about that. The stock licenses, of course, allow for it and why would the client care? I think that a lot of designers get caught up on the notion that if they don’t create every single piece of project, they are somehow compromising artistic integrity. The client wants a quality, legal product. If stock can make the product better and allow me to build it faster, I use it. Back to the original topic, I’m not 3d expert, but I thought the quality here was pretty great. Nice job authors! That said, there’s always room to improve. As the marketplace grows I can’t wait to see even more amazing files.

I suppose it depends on the industry, but there are huge legal implications in doing what hes doing if its a product thats sold worldwide.

When you buy a stock item, you are buying one license for your use. Youre not buying a license for you to use on a product that will sell multiple copies. regardless, this is not the point. its buying something that you didnt create and being credited for it. Which is what hes doing.
There’s actually a special license for things like games and anything else you’re planning to distribute. As long as you get the extended license, it’s totally legal.

You seem to be missing the key point.

“I have done alot of work mainly in the games industry and i have often had to buy model from sites to meet deadlines or use as a starting point so i know what i am looking for and alot of the models on 3d ocean would not meet these requirements”

He is taking other peoples work and being credited for it. When actual development studios do this, they go through the proper licensing like you mentioned and credit the author.
As the site manager of ActiveDen, I’m pretty familiar with our own licenses. That’s totally legal as long as the proper license is purchased. Files purchased with the extended license may be used in games that are distributed commercially or free. Not only is it perfectly legal, but that’s what these marketplace are for – to allow design firms and freelancers to save time and create a better product. That is, of course, what the client is interested in.

you just keep going back to the licenses. it is NOT OK to take someones work and claim it as your own. its ok to buy licenses and use it, but that person is credited with the work. Look at any videogame credits that has outsourcing or stock use.. from Metal Gear to Modern Warfare, they all credit the original.

(b) Unless you have our prior written consent, you must not directly or indirectly license, sub-license, sell or resell the Product or offer to do any of these things. All of these things are referred to as Resale.

(d) Your use of the Product is limited to a single application.

(f) You must not incorporate the Product in a work which is created for Resale by you or your client.

Hey Guys, Please watch the language. If it gets out of control, I will have to lock this thread. :(

No problem, its just frustrating to see this mindset and people thinking its OK to do this.

Artists buying models that they did not create for a game development job THEY got hired for is very unethical and is not done by professionals.. Even as a starting point.. What gives some 3D Modeler the right to just buy a model and use it in game dev when in the end YOU get credit while the original artist goes unsung…

Some studios buy models from Sites like Envato or Turbosquid and that is different.. It goes through the proper channels to assure that a license is aquired and credits its creators…

Someone who may have been hired as an environment Artist (for example) has no right to buy a model and use it in the manner you are writing about.

Maybe i read it incorrectly but, it is very insulting and someone who cant meet deadlines for a project and resorts to the method stated above should be fired on the spot.

The clients are told and asked if they want custom models, and warned that it will take longer but alot of client are not bothered as they want the work done quicker than is possible to with the given time frame,

Alot of things in the real world are done slap dash as deadlines are always looming, good artists do use other people work when needed but in all cases it has be stated and in about 50% of case the company get in touch with the original artist and put them on the books for freelance modelling!

Im calling bullshit on this right now. In all my time working in games, NO ONE has ever done this. Anything outsourced was done on an executive level and properly licensed. Our art director would go to our producer and producer would go to the publisher..

Your last statement doesnt justify anything.. YOU assume 50% of people dont get credited… where are you getting this information? the previous post? Find me ANY professional games out there that are using models from a stock site and not crediting.

If my team or myself ever had a deadline to meet we didnt buy stock and claim it as our own. WE STAYED till 3am or whenever we needed to to get the job done.
